1. INTRODUCTION

These Terms of Service (the “Terms”) govern access to and use of www.mccosmetic.com (the “Website”) and the purchase of products through the Website.

By placing an order, the Customer confirms acceptance of these Terms, together with the applicable Shipping Policy, Returns and Refunds Policy, Cancellation Policy and Privacy Policy.

2. ELIGIBILITY

The User represents that they have the legal capacity necessary to enter into binding agreements.

Where an order is placed on behalf of a company, clinic, professional establishment or other organisation, the individual placing the order confirms that they are authorised to act on behalf of that organisation.

The Website may be used only for lawful purposes.

Certain products may be intended for professional use.

The Customer is responsible for determining whether they are appropriately qualified or authorised to purchase, receive, store and use the products.

Where professional application is required, the Customer is responsible for ensuring that the products are applied or administered by appropriately qualified professionals.

Product descriptions are provided for commercial and informational purposes and do not replace professional training, medical advice, diagnosis or treatment advice.

5. REGULATORY AND IMPORT RESPONSIBILITY

For international purchases, the Customer is responsible for verifying whether the products may legally be purchased, imported, received, stored and used in the destination country.

The Customer is responsible for any applicable:

  • import licences;

  • permits;

  • professional authorisations;

  • registrations;

  • customs procedures;

  • taxes and duties;

  • local regulatory requirements;

  • product notifications; and

  • other destination-country requirements.

Where applicable, the Customer may act as importer, consignee or importer of record.

MCCosmetic may provide reasonable commercial assistance but does not assume the Customer's legal or regulatory responsibilities.

6. ORDERS

The Customer must provide accurate information when placing an order.

MCCosmetic reserves the right to refuse or cancel an order where reasonably justified, including because of:

  • stock availability;

  • pricing errors;

  • payment issues;

  • suspected fraud;

  • incorrect information;

  • regulatory restrictions;

  • import restrictions; or

  • other legitimate operational or commercial reasons.

7. PRICES

Prices are displayed in euros unless otherwise indicated.

Applicable taxes are charged in accordance with applicable law.

Shipping, customs, import duties and other destination-related costs may be charged separately.

MCCosmetic reserves the right to change prices and promotions at any time, subject to applicable law and accepted orders.

8. PAYMENT

Payment must be completed using an available payment method.

An order may be suspended or cancelled where payment cannot be verified or completed.

The Customer confirms that they are authorised to use the selected payment method.

9. DELIVERY

Delivery times are estimates unless expressly guaranteed.

The Customer is responsible for providing accurate delivery information and ensuring successful receipt or collection.

MCCosmetic is not responsible, to the extent permitted by applicable law, for delays resulting from:

  • carriers;

  • customs;

  • regulatory authorities;

  • incorrect Customer information;

  • failure to collect;

  • refusal of delivery;

  • weather;

  • strikes;

  • transport disruption; or

  • other circumstances outside MCCosmetic's reasonable control.

10. CUSTOMER RESPONSIBILITY FOR RECEIPT

The Customer is responsible for ensuring that the goods can be received at the destination.

The Customer must ensure:

  • accurate delivery details;

  • recipient availability;

  • compliance with carrier instructions;

  • compliance with customs procedures; and

  • compliance with applicable import requirements.

Where failure of delivery results from Customer-related circumstances, reasonable resulting costs may be charged to the Customer to the extent permitted by law.

11. RETURNS AND REFUNDS

Returns, refunds and withdrawal rights are governed by the applicable Returns and Refunds Policy and mandatory applicable law.

12. CANCELLATIONS

Customers may request cancellation by contacting:

Cancellation may not be possible once an order has entered processing or has been dispatched.

Where legally permitted, costs incurred following Customer-requested cancellation after processing or dispatch may be charged or deducted from any refund.

13. COMMERCIAL FLEXIBILITY

MCCosmetic may, at its discretion, offer exceptional commercial solutions, including replacement, re-shipment, credit, refund or alternative delivery.

Any such solution is case-specific and does not create a precedent or contractual entitlement.

14. INTELLECTUAL PROPERTY

  • carrier delays; and

  • force majeure events.

Nothing excludes liability that cannot legally be excluded.

18. FORCE MAJEURE

MCCosmetic shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including:

  • natural disasters;

  • war;

  • civil unrest;

  • government measures;

  • strikes;

  • transport disruption;

  • cyber incidents;

  • supply-chain disruption;

  • epidemics or pandemics; or

  • other force majeure events.

19. SUSPENSION OR TERMINATION

MCCosmetic may suspend or terminate Website access where reasonably necessary due to:

22. SEVERABILITY
